论行政指导在环境管理中的实现

行政指导作为一种新型的环境行政管理手段,属于灵活柔软的管理方式,由于其显著的效果而得到广泛的应用。环境行政指导对环境立法起到检验和预测作用,也与常规的环境行政管理相辅相成,对环境污染起到防治作用。在我国,虽然政策、法律已经对环境行政的指导作出了一些相应规定,但是还存在很多缺陷,理论研究不足、缺乏程序控制、救济机制不完备等。我国应当完善环境指导立法、加强公众参与、促进信息公开、完善激励机制。

The realization of Administrative Guidance in Environmental Management

Administrative guidance,as a new-type means of environmental administration,belongs to a flexible administrative mode and has been widely applied due to its outstanding achievements.The Administrative guidance concerning environmental issues,plays a checking and predicting part for environmental legislation and a preventing and curing role for environmental pollution since it is supplementary to the regular environmental administration.In China,though the policies and the law have already put forward some corresponding stipulations concerning the guidance of environmental administration,there still exist many drawbacks such as insufficient research,lack of procedural control,incomplete rescue mechanism,etc.Now,legislation should be improved about administrative guidance,public engagement be strengthened,information transparence in the guidance of environmental administration be promoted and related incentive mechanism be perfected.
