| 摘 要： | 我国的产品质量法经过2000年修改后,有很大的进步,但是有关问题仍值得探讨.产品质量法中"产品"的界定有待拓宽;新法吸收了旧法的精华,仍采用将"损害赔偿"与"罚则"分开的立法模式,但应加强产品责任立法,使我国的产品质量法真正成为产品责任法;产品瑕疵和产品缺陷的有关问题也亟需进一步考究.

The definition of products is too trivial, and the punitive damages should be imposed on the products and sellers. It is necessary to distinguish the flaws of products and the defects of products. The legislation of product liability should be established. |
