论证人证言规则

两个证据规定的颁布,使得一系列旨在规范证人证言审查判断活动的证据规则得到确立。而2012年3月14日通过的刑诉法修正案,又对证人出庭作证问题确立了程序保障规则。由此,对证言笔录证据能力的限制、对非法证言的排除规则、对证人出庭作证的明确要求,以及对证言印证规则的接受,构成了中国证人证言规则体系的有机组成部分。但是,证人证言规则要得到有效的实施,还需要克服一些来自司法体制、诉讼程序和证据制度方面的困难和挑战。

Witness Testimony Rules

The promulgation of two provisions of evidence makes a series of rules of evidence which aims at regulating witness testimony checking activities be established.Meanwhile,the Criminal Procedure Law Amendment which is about to pass establishes procedure guarantee rules for details as witness testifying at the court.Thus,the restriction to testimony record evidence capability,the exclusionary rules for illegal testimony,the clear requirements for witness testifying at the court and the reception for testimony confirmation rules all constitute the organic and integral parts of Chinese witnesses’ testimony rule system.Yet,the effective implementation of witness testimony rules requires overcoming difficulties and challenges from such aspects as judicial system,legal procedure and evidence system.
