| 摘 要： | 根据系统论的观点,系统功能由环境、结构、要素三者共同决定.将系统论的研究方法引入到陪审员制度当中,有助于更好地理解陪而不审现象产生的原因.在系统环境难以改变的情况下,要缓解陪而不审现象,只能对系统结构和要素进行优化.

| Abstract: | According to the viewpoint of system theory,the system function was decided by the environment,the structure,and the essential factor.Introduction of the system theory to the juror system is helpful to understand the reason why the jurors do not participate in the trial.With the hardly changing situation of the system environment,we can only optimize the structure and elements in order to mitigate this problem. |
