论医疗损害责任制度改革的现状与问题

我国医疗损害责任制度的改革肯定了民事侵权责任在我国医疗损害责任领域的基本地位;形成了以直接诉讼方式来解决医疗损害责任的主导机制;呈现出用一般人身损害赔偿制度来解决医疗损害赔偿的基本局面,其中的直接起诉制度、医疗损害赔偿的一般化、医疗证据鉴定制度的不统一是目前医疗损害责任改革存在的基本问题。

Analysis of medical malpractice liability reform in China

The reform of medical liability for damage in China affirmed the basic status of tort responsibility in the field of medical damage liability,formed the dominant mechanism to resolve medical malpractice liability by direct action,adopted the general personal injury compensation system to compensate the medical damages.The direct litigation of medical malpractice liability system,the general compensation of medical damage,and the inconsistent of medical evidence identification system were the basic problems of medial malpractice liability reform in China.
