| 摘 要： | 从刑事和解的含义、起源和特点入手,论述我国实行刑事和解制度的基础与必然。在对我国实行刑事和解制度设计构想方面,认为应根据刑事和解的本质,贯彻宽严相济政策和权力须受监督的精神,以促进被破坏社会关系的修复,构建和谐社会为目标,来科学设计刑事和解的具体制度规范。

| Abstract: | This paper deals with the foundation and necessity of introducing criminal reconciliation system,together with its definition,origin and characteristics of criminal reconciliation.When it comes to carrying out criminal reconciliation in China,it is expected to carry through temper criminal policy with mercy and the spirit of power supervision based on the nature of criminal reconciliation,to resume the worsened social relations.Concrete institutional regulations should be designed scientifically aimed at a harmonious society. |
