论探矿权在我国物权体系中的定位

分析探矿权的特殊法律属性，对探矿权在用益物权体系中的定位进行研究，以保证调整探矿权法律关系的法律规范能够正确适用，探矿权人能够适当行使权利并在权利受到侵害时得到有效的救济。研究认为探矿权在权利取得、权利客体和地勘成果权利上具有不同于传统用益物权的特征，这些特征并不影响探矿权的物权属性，但在法律规范上应当在适用用益物权一般规范的前提下通过特殊的规则进行调整。应当建立一套准物权理论体系，研究准物权的特殊法律性质，以丰富传统用益物权理论。探矿权作为具有公权力色彩的私权，在法律调整上应当在用益物权一般规则的指导之下适用民事特别法进行规范，并相应建立专门的准物权权利体系和理论系统。
