| 摘 要： | 前科消灭制度是指曾被定罪或者判刑的人,在具备法定条件时,注销其犯罪记录的制度.各国前科消灭制度都有相应的条件、程序和后果.我国建立未成年人前科消灭制度符合刑罚趋轻原则、刑罚功能评判标准、未成年人保护精神.在建构过程中不断完善其实体要件、程序要件、法律后果.
