无固定期限劳动合同之规定的合理性

摘    要:《劳动合同法》规定的无固定期限劳动合同制度具有很强的合理性,取消无固定期限劳动合同的观点是错误的。无固定期限劳动合同并非"终身制",用人单位可以依法解除;无固定期限劳动合同并不是我国《劳动合同法》所新创,在外国法律及我国原来的《劳动法》中早有规定;无固定期限劳动合同之规定,符合中国客观的政治、经济现实,不仅仅只对劳动者有利,对用工单位也是有利的。

Abstract:The regulation of open-ended employment contract in the"employment contract law"is highly reasonable,the view of abolishing the open-ended employment contract is wrong:Open-ended employment contract can be ended,the employers can termi- nate the contract according to the law; Our new law are not the first that provisions"Open-ended employment contract",Foreign laws and the old"Labor Law"in China has provisions it in already; Open-ended employment contract,as provided for in line with the ob- jective of China's political,economic,reality,not only beneficial to workers,the labor unit is also beneficial.
