任意犯罪集团首要分子刑事责任认定中的若干问题

2008年全国打掉了许多涉黑涉恶团伙,这对于社会秩序的维护无疑十分重要,但在打击犯罪的同时又需根据罪刑法定原则保障犯罪分子的合法权利。我国刑法规定,犯罪集团的首要分子应当对集团所犯的全部罪行负责,但＂集团所犯的全部罪行＂如何理解尚待解释,例如当实行过限难以判断时、当首要分子之间发生承继时、当集团成员发生错误时如何归责。
