涉数据网络犯罪的规制困境与优化路径

Data-related cybercrime takes data infringement as the core. The main types include computer crime, personal information crime, copyright crime and telecommunications network fraud. As a key factor in the development of the information society and the digital industry, data has risen to an unprecedented national strategic level in the era of big data. The spread and mutation of data cybercrime have seriously jeopardized the legal interests, economic order and national security of individuals. At present, there are some problems in the criminal regulation of data cybercrime, such as lagging governance thoughts, narrow legal protection benefits and ineffective regulatory effects. Therefore, it is necessary to expand the modesty of criminal under the idea of network governance, adjust the type and scope of legal interest protection, achieve the pre-regulation and functionalization of the criminal system, and improve the penalties and cross-domain cooperation mechanism for data-related cybercrime.
