试论财产征用的公共利益目的

在自然法的学说之中,财产权是一种神圣不可侵犯的权利。个人对其所有的财产拥有占有、使用、收益、处分的绝对自由,人们建立国家和置身于政府管理之下的重大的和主要的目的,便是保护他们的财产。然后,私有财产应当从属于一个更高的社会目标,即基于公共利益的需要,个人应当作出必要的让步和牺牲,因此,公共利益的认定也就成为财产权保障的关键。

On The Aim of Public Interest in Eminent Domain

In the words of natural law, property right is exempted from infringing. The owner can engross, use, proceeds and deal with his property. The motive is to protect their property in uniting a country. In fact, personal interest should yield the public use. Therefore, to distinguish from the personal interest and public use become very important.
