网络社会中虚拟财产的社会学审视

虚拟财产是网络社会中的重要概念，因其兼具虚拟和现实的双重身份而在法律属性和立法保护上存在较大的争论。虚拟财产的财产属性是对其进行法律保护的前提。运用社会学中的价值理论、冲突理论和符号互动论对虚拟财产进行分析，明确虚拟财产具有价值性、排他性和稀缺性的特征，得出虚拟财产具有财产属性的结论。应该从建立基本法规、完善价值确定规则、明确主体与客体的权利和义务以及设立虚拟第三方等方面入手，对虚拟财产进行立法保护。

A Sociology Analysis on Virtual Property of Cyber Society

Virtual property is an important concept of the cyber society. Because of its both virtual and real dual status, there is a big controversy in legal nature and legislation protection of virtual property. Virtual property＇ property nature is the premise of its legislation protection. Using the labor theory of value, conflict theory and symbolic interaction theory of sociology to analyze virtual property, it is clearly presumed that virtual property has value, exclusive, and scarcity of the characteristics, and that virtual property has the nature of property. Therefore, we should enact relevant laws to protect virtual property by establishing basic laws, improving the value determined rules, clearing the subject and object of the rights and obligations and setting a virtual third - party.
