| 摘 要： | 随着国际经济的发展,国际间的交往也愈加频繁。法人作为涉外民商事法律关系的主体,在国际民商事交往中扮演着重要角色。各国依其自身利益采用不同的标准来确定法人国籍,由此带来了法人国籍的变动。依据我国现阶段国情,我国应以主要办事机构所在国的国籍为法人国籍,以此来解决法人国籍的冲突。

| Abstract: | With development of international economy,communication among countries is extending drastically.Legal person,as a subject in legal relations of commerce and civil involving foreigner,plays a vital role.Based on their own interest,countries have adopted different rules to determine nationality of legal person,which leading to change of nationality of legal person.Being with analysis the rules upon nationality change of legal person,the author make reflection on China's rules in effect governing determination of legal person's nationality of foreigner,and give some advices on legislation under present condition of China. |
