| 摘 要： | 肉刑从五帝时代产生,到清朝完全废除,经历了漫长的历史过程。肉刑在历史中有其特有的预防犯罪和实现报应的功能。肉刑的产生,实现了肉刑报应和预防犯罪的功能;肉刑的反复过程,是寻找肉刑的替代刑的试错过程;肉刑的废除,是肉刑的功能被社会成本更小的刑罚所取代。从刑罚预防和报应功能的角度来解释肉刑产生、反复和废除的过程,这对当前处于困境中的死刑存废问题有所启示。
