| 摘 要： | 现有的国际海上运输法律对地理上的绕航无有统一的界定标准，在法律实践中绕航的合理与否应既考虑到是否符合承运人和全体货主的共同利益，也考虑到当时、当地的客观条件和当事人的事先约定。不合理的绕航导致与其具因果关系的实际损害及构成重大违约，承运人应承担赔偿责任。

| Abstract: | urrent law for international marine cargo shipping has no unanimous stipulation for geographic deviation. In the practice of law, a deviation can be considered rational or not according to whetherit is for the common interests of carriers and all cargo owners, and according to local conditions and the prior agreement of interested parties. irrational deviation may cause direct damage and serious violation of contracts. Carriers are responsible for compensation forconsequent losses. |
