| 摘 要： | 比例原则是行政法的核心原则之一 ,产生于西方国家并在实践中得以发展和完善 ,因其符合客观规律 ,具有强大生命力而在许多国家和地区得到广泛运用。文章在论证比例原则的涵义、功能和科学性的基础上 ,结合我国行政法实践 ,论证了比例原则在我国行政法中适用的必要性。

| Abstract: | The proportion principle is one of the core principles of administrative law, which originates in the western nations, and develops in the practice. It is frequently applied in lots of nations and districts because of its adaptability and conformity to the practice. The thesis points out the necessity in the implementation of the administrative law on the basis of study on its cennotation, function, and scientific nature in the combination of the practice of administrative law. |
