对国有资产信托的法学思考

国有资产管理本质上是对其形态转换过程的管理。信托可以实现其价值形态有效转化,它通过其独特的制度设计和运行机制,可以很好地对国有资产进行经营管理。在国有资产信托中,可根据国有资产的不同特点和需要,采取财产信托、国有股权信托、表决权信托等不同形式。我国已有的信托立法,为国有资产信托奠定了一定的法律基础,但是存在很多不足,应该在基本法律和国有资产信托专门法律两方面进行完善。

The management of state property is essentially that of its conformation transformation.With a unique system design and operation mechanism,Trust can transform its conformation efficiently,thus effectively managing state-owned property.Different forms of trust can be adopted to manage state-owned property,such as estate trust,state-owned stock ownership trust,voting right trust, etc.China's present legislation on trust has laid certain legal foundation for state-owned property trust,but there is much room to be desired,which should be perfected both in basic laws and special laws of state-owned property trust.
