论内地与香港CEPA性质的界定 --类自由贸易协议的国内区际经贸法律安排

CEPA作为中国内地与香港更紧密经贸关系安排,很多评论认为是中国区域经济一体化战略的实质性开端.毋庸质疑,其签订对内地和香港两地经济的更进一步融合和发展有着举足轻重的作用.然而,CEPA签订至今,其性质仍备受争议、未有定论,这不能不说对于CEPA实效的发挥造成了严重的阻碍.本文在此,尝试通过对有关CEPA性质的争议进行甄别和分析,以求厘清和界定CEPA的性质,为CEPA更深入的发展扫清理论障碍.

The Discussion of Ascertaining the Character of CEPA between Mainland and Hong Kong --A National Arrangement of Economy and Trade as Quasi- Free Trade Agreement

As a Mainland and Hong Kong Closer Economic Partnership Arrangement,CEPA is deemed to be a substantial threshold of the regional economic integration of China.Obviously,the effect of subscribing such an arrangement holds the balance of the amalgamation and development of the economy between Mainland and Hong Kong.But until now the character of CEPA is still disputed and uncertain,which has become a obstruct of the exertion of the actual effect of CEPA.This thesis here tries to analyze the disputes of the character of CEPA and find out the real character of CEPA.
