德—法整合的法哲学原理

道德与法律、德治与法治的关系 ,从根本上说是一个方法论和价值观难题 ,只有在以有机性、整体性为方法论 ,以社会文明的生态合理性为价值观的法哲学的辩证体系中 ,才可能获得理论解决。法哲学的基本问题 ,是人的行为的正当性和社会秩序的合理性 ,由此展开为“必须”—“应当”合一的逻辑结构、“家”—“国”一体的历史结构、伦理—政治生态的现实结构。三者的统一 ,就是法哲学的辩证体系。在这个体系中 ,道德与法律 ,德治与法治 ,得到了逻辑、历史、现实的整合。

The principle of philosophy of law in the unification of morality and law

The relationship between morality and law,and between the rule by morality and the rule by law,is actually a problem concerning methodology and values.This problem can only find a theoretical solution in the dialectical system of philosophy of law which takes the organic whole as methodology and the biological rationality of social civilization as values.The fundamental point of the philosophy of law lies in the justice of human behavior and the rationality of social order,thus leading to the logical unification of "must be" and "should be",the historical unification of family and state,and the realistic unification of ethics and politics.The unity of the above three is the dialectical system of the philosophy of law in which the unification of morality and law,and of rule by morality and rule by law is realized in the logical,historical and realistic sense.
