丁韪良主持翻译《公法会通》新探

《公法会通》是继《万国公法》、《星轺指掌》与《公法便览》之后,丁韪良主持翻译的第四部重要的国际法译作,虽然在承认领事裁判权与不平等条约等方面具有消极内容,但总的来讲,该书详尽地阐述了进步的国家平等、人人平等的国际公法思想和人权思想,对若干国际公法领域的叙述比较详细,观点比较公正,至今仍具有一定的借鉴作用;该书使用的一些政治、外交与法律新名词,逐渐被中国知识界、法律界所接受,有的沿用至今;在文字表达和体例上,该书也是丁韪良主持翻译的最好的国际公法译作。总之,该书对晚清外交界及知识界进一步了解国际法,并运用国际法从事劣势条件下的外交,起到了一定的促进、启蒙和推动作用。

New Exploration on the Gong-Fla-Hui-Tong Preside Over Translation by W.A.P.Martin

Gong-Fa-Hui-Tong was the fourth book on the international law translated by W.A.P.Martin in the Late Qing Dynasty.Although there were some negative elements in the book such as accepting consular jurisdiction rights and unequal treaties,it thoroughly narrated thoughts and ideas of equality between nations in terms of the international law and human rights,and discussed major fields of the international law in an objective view.Some new political,diplomatic and legal terms used in this translated book have been used until now.In the usages of terms and style,this book is Martin's best translation in the field of the international law.This translated book enlightened and stimulated Chinese diplomats' and intellectuals' understanding and implementation of the international law when the Late Qing Dynasty was in inferior situations.
