| 摘 要： | 剖析学生在校发生人身损害赔偿案件的特点，对目前处理此类案件的做法进行评析，然后从侵权行为的归责原则着手，论证了学校只有在有过错的情况下才承担法律责任，在无过错的情况下不承担法律责任，并提出了法律救济途径。

| Abstract: | An analysis is conducted of the characteristics of indemnity case involving the student's injury at school, and comments have been made on popular practices of settling the case. From the discussion of the liability principle of tort, the article has demonstrated that the school is legally liable only when it's found with faults, otherwise the school should not take any legal responsibilities. Legal remedy channels have been proposed in the article, too. |
