| 摘 要： | 传统知识是传统部族在历史漫长的精神生产和知识创新过程中孕育、传承而成的结晶。传统知识的综合保护模式包括积极保护与防御保护两种。就积极保护模式而言,主要包括专有权保护机制、补偿责任机制、尊重习惯规则三类,如何有效发挥各机制的保护作用将是传统知识保护的关键问题。

| Abstract: | Traditional knowledge is invented and used by conventional tribesmen in a long history.The synthetic protection of traditional knowledge includes initiative protection and preventive protection.Initiative protection mainly includes property protection system,compensatory liability system,and respecting customs and rules.The key to protecting traditional knowledge is how to bring to fruition the function of the systems. |
