矿工劳动权状况的国内外比较与启示

作为我国转型时期的弱势群体，矿工的社会经济地位低下，平等缔约权、劳动报酬权、休息休假权、职业培训权等劳动权益受到不同程度的侵害。而西方各国在经历大工业的初步发展以后，纷纷将法律保障的重心由发展经济转向劳动者权益保障。我国应该借鉴国外的成功经验，逐步调整立法价值取向，完善法律体系，健全监管制度，并且提升矿工的组织化水平。

Comparisons and Enlightenment on Miner's Labor Rights

As a vulnerable group in China＇s transition period,miners are in low socio-economic status,and their labor rights such as the right to contracting equally,the right to remuneration,rest and vacation,and the right to vocational training are violated in different degrees. However, after the preliminary development of industrialization, western countries have had the legislation focus change from developing economy to protecting workers＇ rights and interests. We should utilize their successful experiences to adjust legislation value, perfect legal system and supervisory system,and improve miners＇ organization level gradually.
