数字版权管理系统对消费者使用行为的严格限制打破了版权法中所设定的权利平衡,授权协议在该系统内扮演着非常重要的角色。这些授权协议设定了详细的使用规则,又通过设立合同义务来保护技术措施,它们与技术保护和反规避立法一起,构成了版权保护的严密的体系。这一体系严重影响了数字内容用户的权利,并且对版权法造成了冲击,对此,需要调整现有法律框架以规制数字版权管理授权协议的滥用。

A Study of Authorized Agreement of Digital Rights Management

Digital Rights Management’s(DRM) strict limitation on accessing and using of the copyrighted digital materials has broken the balance embodied in copyright law.The authorized agreements play an important role in the whole DRM system.These agreements not only provide detailed rules for the access and the use of digital works,but also have provisions of protecting technical measures used in DRMs.Together with technological protections and the anti-circumvention law,the powerful protection systems form the compact rights protection.These systems have serious impact on the rights of user and the traditional function of copyright law.Therefore,it is necessary to adjust existing legal systems to regulate the abuse of DRM authorized agreements.
