| 摘 要： | 自然科学的方法论对近代以来的法学研究产生了根本性的影响。以此为基础,在法律理论上,法律实证主义和法学实证主义都主张法学研究对象具有独立性,研究方法具有科学性。然而,他们也存在缺陷,如果我们认识到法学作为人文科学的特质,就会自觉地对该主张进行合理的修正。
