| 摘 要： | 系统范畴具有普遍性,以系统论的观点考察民事诉讼法律关系,可发现这一关系所内含的种种系统特质。其中,人民法院、当事人和其他诉讼参与人是构成系统的主体要素,因彼此间的权利、义务结构而相互影响,形成两个层次,并始终与以人民检察院为主要代表的环境因素发生信息交换,促使系统整体向着更加有序的方向演化,并保障社会各项事业正常进行。

| Abstract: | By using system theory to examine the system of legal relationship in civil lawsuit,the system features in this relationship can be detected.The main elements in the system are people's court,litigants,and other parties concerned.The rights and obligations among them are interactive,and are in agreement with people's procuratorate,so that the relationship system advances in an orderly way to make sure the smooth development of the social causes. |
