论知识产权的法律冲突

知识产权的地域性决定了知识产权与法律冲突绝缘,而知识产权的国际性和知识产权管辖权制度的变革也不会使知识产权产生法律冲突。但是,知识产权的法律冲突是可以也是可能存在的,它只源于知识产权地域性的突破,一国对外国知识产权的直接承认。然而这一突破和承认就目前来看是非常有限的,因此,知识产权的法律冲突也只能在有限的范围内出现。

Comment on Conflict of Laws on Intellectual Property

The regionalism of intellectual property makes merely conflict on the law of intellectual proper- ty,and the system changes of the international jurisdiction also will not make legal conflicts in intellectual property.However,the intellectual property conflict may exist,it is only because of the breach of Regionalism of intellectual property,and the recognition of a country to foreign intellectual property.However,the break- through and recognition is very limited in current situation,therefore,the conflict of law about intellectual property only exit within limited extent.
