| 摘 要： | 从一起抚养案件判决的执行可以看出,民事执行中司法解释的演变可能会导致对判决主文不同的解读,执行法官要理性地比较判决的不同解读并进行选择。一般而言,在民事案件判决的执行过程中,应根据现行的法律及司法解释来解读一份判决。

| Abstract: | The execution of a maintenance case shows that judicial interpretation evolvement in civil execution is likely to result in different understanding of a judgment text. That's why executive judges should consider rationally the different decoding of a judgment, and then make a dicision. Generally, a judgment text should be interpreted on the basis of current law and judicial interpretation in the executive process of civil cases. |
