民初内阁倒台的法学透视

民初内阁更迭、以至最后倒台,纵然有它的政治、历史原因,但从法律文化的角度分析,这场法律移植的失败明显是由于中国传统的法律文化与西方法律制度的冲突造成的。虽然,短时期内改变中国人保守、落后的法律文化观念是不可能的,法律移植的失败有其必然性,但应肯定近代先进的民主人士“明知不可为而为之”的勇气,因为这种法律移植为最终实现中国法制的现代化积累民主宪政的经验。

Failure and Hope:Insights into legal Transplanting in the Case of Rise and Fall of Cabinet System in the early Republic of China

Though there are political and historical causes for the failure of cabinet system in the early Repubilc of China, but analysis from perspective of legal culture showes that, failure of this legal transplanting was resulted mainly from the conflict between two different legal cultures. The failure seems inevitable in consideration of backward traditional legal conceptions among most people, but pioneers' efforts in transplanting modern legal system should be positively valued梑ecause it represents inexorable trend of the development of rule of law.
