| 摘 要： | 我国《著作权法》对“合理使用”的适用范围采用列举式，这种列举式权利限制模式在面对数字图书馆著作权的合理使用问题时显得过于狭窄。随着信息技术的快速发展，在数字图书馆建设中，著作权人与社会公众的利益平衡被打破，矛盾更加突出，因此，我国亟需完善或扩充著作权合理使用制度。对此，拟通过重新确定著作权合理使用的一般性原则和范围，完善著作权法律体系，为数字图书馆建设奠定法律基础。
