粤港澳合作框架协议审议机制论析

粤港澳合作框架协议是＂一国两制＂方针下的国内区际合作模式,是我国在遵守WTO法律规则基础上对区域经济合作模式的重大突破。合作重点亮点突出,合作领域广泛,但对于合作框架协议的审议机制没有明确的规定。参照国际区域合作的成功经验和值得思考的制度缺失,文章认为要从粤港澳的紧密关系出发,以＂一国两制＂的方针为指导,构建以协商谈判为主、以法律手段为辅的审议机制。

Analysis of the Review Mechanism of Guangdong-Hongkong & Guangdong-Macao Cooperation Framework Agreements

The Guangdong-Hongkong & Guangdong-Macao Cooperation Framework Agreements represent a new regional cooperative model within China under the "one country,two system" policy.These two cooperation agreements mark a big breakthrough for the regional economic cooperation within China without violation of the WTO law.Although the agreements make clear the highlights of the cooperation,and enlarge the scope of cooperation,they do not specify the review mechanism under the cooperative framework.Based on the successful experiences of the regional cooperation worldwide,and considering the lack of the relevant system,this paper suggests that the review system of these two framework agreements should,in accordance with the "one country,two system" policy,mainly be established through consultation and negotiation,with law as a secondary device,so as to boost the close relationships between Guangdong and Hongkong,and between Guangdong and Macao.
