略论美国劳资关系管理模式的演变

摘    要:从美国立国伊始至20世纪40年代,美国劳资关系管理模式的发展主要分两个阶段。第一阶段是法院主治劳资关系管理;第二阶段是立法主导劳资关系管理。前一阶段中,美国法官在劳资关系管理中居主导地位,主要适用普通法的刑事共谋罪和禁令手段调整劳资关系。后一阶段国会的立法逐渐成为调整劳资关系的主要规范,并最终经由联邦立法确立了国家劳资关系管理模式。

Abstract:From the founding of America to 1940s,the development of American Mode of industrial relations can be divided into two stages.During the first stage the courts play a dominant role in the management of industrial relations,American judges frequently adopt criminal conspiracy and injunction to regulate industrial relations.But the legislature takes over the dominant power during the second stage,the statute step by step becomes the main norms of industrial relations,and finally leads to the formation of industrial relations management system.
