| 摘 要： | 本文在对当前学术界关于民族区域自治主体的观点进行反拨辨正的基础上,从宪政维度对民族区域自治主体进行解读。在现代宪政意义上,民族区域自治是宪政的基本要素之一;自治机关难以完成作为民族区域自治主体的自我解证;人的自治性、民主的结构性缺陷以及人权保障的最终指向确证了民族自治地方的全部个体成员是民族区域自治的主体。
