论地方性法规的批准与备案制度

“批准”制度使地方性法规的制定程序过于繁琐，并容易在实践中造成混乱，因此，应明确界定批准的含义、标准和程序，或者废除批准制度，代之以备案程序，赋予两类市以完整的地方性法规制定权。审查并不必然是备案的内容，而是法定机关为行使撤销权所进行的一项前置性工作；将审查视为备案的内容反映了人们的一种政治情感并有其现实依据，然而，要克服立法工作中的无序现象，关键是应该尽快启动事后监督制度。

On the Approval and Record Systems of Local Regulations

The approval system makes the procedure of two municipal local regulations overelaborate,and easily results in confusion in practice. Therefore, the approval system should be further perfected, the meaning ,standard and procedure of the approval within circles must be definited; or the approval system is abolished , the record procedure is used instead, the two kinds of cities are entrusted with complete power of local regulation enactment. Record and examination are two systems with different natures. Examination which is preparing work the body in power takes for the power of abolishment should not be concluded in record. Regarding examination as a part of record reflects a sort of people's political feelings which has its own realistic foundation. However, the system of legislative supervision should be started as soon as possible in order to overcome the disorder in legislative practice.
