| 摘 要： | 职务犯罪是困扰中国现代化进程的一个突出问题,是腐败现象最极端的表现,而职务犯罪中的共同犯罪社会危害性更大。本文提出职务犯罪中共同犯罪的概念及其特征,进而将职务犯罪中的共同犯罪划分为国家工作人员之间构成的共同犯罪和国家工作人员与非国家工作人员之间构成的共同犯罪两种类型,并指出职务犯罪中的共同犯罪人按“国家工作人员所构成的职务犯罪性质定罪处罚”的处断原则。

| Abstract: | As a haunting problem in the modernization process of China, official crimes the corruption going to the extreme and stili more perilous to the society are joint official criraes. The thesis puts fonvard the definition and characteristics of joint official crimes, divides joint official crimes into two types as joint crimes among state personnel and joint crimes bervveen state personnel and non-state personnel. Moreover, it points out the principal of convicting and sentencing joint offenders in official crimes according to the nature of joint official crimes committed by state personnel. |
