| 摘 要： | 所有权限制具有深刻的理论意义。笔者认为,公平（正义）、效率、秩序、法治、自由是所有权限制最基本的理论意义所在,它们从法的价值高度体现出所有权限制的理论价值,与我国《物权法》的立法目的和宗旨殊途同归。

| Abstract: | The restriction of property right not only has solid theoretical foundation, the restriction of property right is not our subjective,nor one side of the story,and in fact it has profound theoretical significance. I believe that fairness （justice）, efficiency, order and the rule of law, freedom are the most basic theoretical significance of the restriction of property right, From the value of the law that they reflect the theoretical value of the restriction of property right, and the legislative intent and purpose of Chinese ＂Property Law＂ all roads lead to Rome with the theoretical value of the restriction of property right. |
