| 摘 要： | 婚姻，尤其是一夫一妻制婚姻是一个道德性、伦理性很浓的法律实体，在婚姻关系中道德与法律呈二元互动结构。结婚、婚后生活及离婚，不仅是道德问题，同时也是严肃的法律问题，婚外恋、第三者涉足别人家庭、通奸诸问题，均应作如是解。婚姻离不开道德、离不开责任，当然也离不开法律，这是婚姻这种社会组织体存在并继续发挥其不可替代的作用的基本前提。

| Abstract: | Marriage,especially as the monogamous model is concerned,is a moral and ethical entity in law.In marriage,morality and law are in a dualistic relationship of mutual influence. Marriage,married life and divorce are not only subjects in morality but also serious subjects in law. So are problems like love affairs and adultery. Marriage can't go without morality,obligation and law in particular,which is the basic premise for marriage to exist as a social body and continue to play its unsubstitutable role. |
