论塑造罪刑法定的刑事司法品格

It is the victory of a phase made in Chinese legislative history through long-term and difficult tests and disputes. In order to overcome the obstacles of the principle in judicatory, it is ideal to balance the principle, explanation and judgement. We should mould its character that combines the human rights protection of the actual cost of the principle with the social protection under the frame to establish the authority in the criminal field governed by law of the legal principle of crime and punishment, and to make it become emperor rule of criminal law worth the name.
