论法哲学视野下的法律推理重构方案

在法律推理中，实现形式正义的首要条件是法律必须具有一致性、可预见性和可计算性。在制定法律或立法时，鉴于已经发生的事实通常需考量一般的情况；在涉及到交叉性问题的时候往往难以就边缘性问题予以周延的思考与制度性的安排；在现实与规范的平衡中，需从内容极为复杂的法律体系中寻找大前提即确立法律规范，同时这个过程又涉及小前提即法律事实；就链接过程而言，需要不断探索法律事实与法律规范间最合理、最密切联系的策略；对事实向规范的转化以及由规范向审判的转化中，需探索建立关于事实、规范与价值的结构体系，使一般逻辑涵摄模式充分兼顾法律事实对法律规范的映射，以及法律规范对法律事实的适用。

On Reconstruction of Legal Reasoning Under the Perspective of Law Philosophy

In legal reasoning,the first condition is that the law must be consistent,predictable and computable.In the formulation of laws or legislation,in view of the fact that has already happened, we usually consider the general situation,and when it comes to cross problem which is difficult to be thoroughly thinking and marginal problems of institutional arrangements,we shall establish legal norms from the legal system that is extremely complex in the premise in reality and normative balance, and this process also involves the small premise legal facts,and when it links the process,we need to continuously explore legal facts and legal norms of the most reasonable,the most closely linked strate-gy for the truth to the standard conversion and conversion from regulations to trial,and we should ex-plore the establishment of structural system about facts,norms and values and make the general logic culvert perturbation model consider the legal fact of applicable legal norms and legal norms of the mapping of the legal fact.
