完善我国标准化法律制度的若干思考

目前发达国家对发展中国家的出口贸易广泛实施技术性贸易壁垒。由于我国的标准化工作及其法制建设滞后，技术力量薄弱，已制约了经济技术发展。在入世之后，我国完善标准化法律制度要从两个方面入手，一是在标准化法制建设中要急需兼容WTO／TBT协议的相关规则，二是要进一步完善对标准制定过程和技术标准许可使用中限制竞争的反垄断法规制。

Thoughts on the improvements of legal system standardization

Technical Barriers to Trade (TBT) are extensively used by developed countries for the purpose of restricting the export of undeveloped countries.What is lacking in the work is the standardization of the construction of legal system and the application of more advanced technology,which has restricted the development of economy in China.After China's entering WTO,the improvements of Legal System Standardization need to be perfected in two aspects.On the one hand,rules need to be established to take the Agreement on Technical Barriers to Trade into consideration; on the other hand,improvements need to be made in the making of antimonopoly laws in the process of constituting standards and the restricting of competition in the authorized use of technical standards.
