摘    要:我国劳动争议救济制度由于其本身制度设计的缺陷及法律规定的不健全,给劳动争议案件的及时有效处理和劳动者合法权益的维护带来诸多困难。解决这一问题首先要重新确立劳动申诉时效与诉讼时效、仲裁与诉讼、工伤保险赔付与民事损害赔偿等相互关系;明确规定劳动诉讼时效;改革裁审合一的单轨制救济模式,实行裁审分离的双轨制;赋予劳动者更多救济途径,以有效保障和维护劳动者合法权益。

Abstract:Because the system design and the legal provisions of the relief system of labors disputes are not perfect in our country,it brings about many difficulties to deal with the cases of labor disputes timely and effectively and to safeguard the laborers interests.The article considers that the relationships between the limitation of legal proceedings and appeal of labor,arbitration and lawsuit,and the compensation of injury insurance and civil damage must be reconfirmed to solve the problems.To safeguard the laborers interests, we must provide the limitation of legal proceedings of labor explicitly,replace the one-way's relief model of integrating with hear by the two-way's relief model of separating judgment from hear,and entrust laborer more relief ways.
