| 摘 要： | 刑事法律援助是国家的义务和责任。我国当前的刑事法律援助体系并完善,规范分散,立法层次较低,并且在微观上存在着诸多问题,不利于刑事司法人权保护。应当借鉴主要法治国家的经验,制定我国的《法律援助法,》构建完善的刑事法律援助体系,加强对刑事司法人权的保护。

| Abstract: | The character of criminal legal aid is the country’s duty and responsibility. The system of criminal legal aid in China is not integrated and perfect now. The regulations are dispersive, and the legislative layer is lower. Also there are a few microcosmic problems in it, which goes against protecting human rights in criminal justice. In order to establish the perfect system of criminal legal aid and strengthen human rights protection in criminal justice, we should use the experience of main countries of “rule of law” for reference, and constitute China’s Legal Aid Law. |
