| 摘 要： | 罗马法中先占属于万民法中的取得方式之一,并为大陆法系国家民法所继承。我国现行民法没有先占制度。针对罗马法中先占的含义、性质、构成、法律效果进行讨论,将有助于填补国内先占理论研究的空白,值得国内在将来设计先占制度时加以借鉴。

| Abstract: | In Roman law,the first occupancy is one of the ways to gain the ownership,which was carried down through national civil law of the Continental law family.In the civil law of our country,there is no regulation about the occupancy system.This paper discussed the meaning,nature,composition,and effect of the Roman law,aiming to fill up the blanks of theoretical research of occupancy and to be the references in designing the first occupancy system in China. |
