公有制、物权法和物权平等保护原则——以《宪法》第12条第1款之解释为中心

在社会主义公有制条件下,物权平等保护原则是否合宪必须考察其与《宪法》第12条第1款的规定是否相抵触。对《宪法》第12条第1款进行文义解释,辅之于体系解释,并以法意解释加以佐证,可知在物权法中对国家、集体和私人享有的物权进行平等保护,既正确表达了民法的基本价值观念,又符合社会主义市场经济发展的时代要求,并不违宪。

On the Public Ownership, Property Law and the Principle of Equal Protection of Property Right——Based on the Interpretation of Provision 1, Article 12 of Constitution of P.R. China

Under the circumstance of socialist public ownership,whether the principle of equal protection of property right is compatible with Constitution of P.R.China should be examined in such an approach as whether this principle collides with provision 1,article 12 of Constitution of P.R.China.According to the literal interpretation of this provision,there exists surely no collision here.Based on the consideration of systematical and purposing interpretation of Constitution of P.R.China,the equal protection of the property rights owned by the State,the collectives and the individuals not only conveys the fundamental value concept of Civil Law,but also conforms to the developing demands of socialist market economy.
