| 摘 要： | 欧盟、德国温室气体监测统计报告制度,作为欧盟及德国温室气体排放监管体制的基本要素,不仅是欧盟温室气体排放监管的基本手段和行政执法的重要依据,也是欧盟和德国进行温室气体减排政策创新以及构建基于市场机制的温室气体减排制度体系的物质保障和法律政策保障。其在监管主体权责科学配置,确保排放主体如实履行报告义务,第三方查验机构准入监管和核证机制构建,碳配额登记与交易注册平台建设等方面的立法经验,值得我们在建立和完善碳减排政策体系和进行减排制度创新时予以借鉴。

| Abstract: | The GHG monitoring and reporting legal systems in EU and Germany,serving as the basic elements of the GHG emission regulatory system,are not only the most important tools of the administrative laws of GHG emission,but also the material security and institutional guarantee for the policies innovation of GHG emission reduction.More importantly,they provide the legal foundation for innovation of the market-based emission reduction systems.It is worthy of learning for us from the legislative experiences in configuration of the powers and responsibilities for regulatory body,ensuring the emitters to fulfill the reporting obligation faithfully,building the accreditation mechanism of third-party inspection agencies,constructing the platforms for the registration,enrollment and recording of emission allowances and the trade of carbon credits. |
