中西理性概念差异及其对传统法理念的影响

古老的中国文化与西方文化是迥然相异的两种文化类型,从某种意义上说,中国自古以来是缺乏西方这种理性文化的,由此造成了中西法理念的巨大差异,西方的理性精神主要是逻各斯和努斯精神的辩证统一,而中国的理性主要是两个单词的组合即理和性,用理来教化性,以形成以忠孝为皈依以名分为人定位的宗法礼教制度。其实这两者的根本差异在于对人、人性、人格的认识的差异:西方强调人以及人格的独立性,人的自我决定性,倡导自我意志;而中国强调人以及人格的依附性,人的被决定性,最后是取消自我意志。
