| 摘 要： | 即使限于传统法框架,且有明确的法律依据,环境纠纷也很难进入诉讼程序;即使进入诉讼程序,也很难获得公正救济.这与司法独立缺位、司法能力不足以及司法定位局限有关.在对司法机关突破束缚寄予更高期待的同时,维护法律尊严、坚守正义防线是更为现实的选择.
