社会组织商业贿赂行为的特点、原因及其控制——以越轨社会学理论为分析视角

以商业行贿行为为主要表现形态的社会组织商业贿赂行为,是现代商业社会中最典型的越轨行为。其相对于一般自然人实施的商业贿赂行为,具有行为主体的组织性、行为意志的整体性、行为实施的双重性、行为利益的组织独占性、行为范围的限定性等特点。社会组织实施商业贿赂行为,与其理性选择有关,并深受商业场域及商业规则的影响,是社会交换的一种结果表现形态。对社会组织的商业贿赂行为,应通过建构相应的社会控制主体系统、法律系统、手段系统进行社会控制,以使其通过合法行为进行商事交易,成为其理性选择的结果。

The Characteristics, Causes and Control of Business Bribe by Social Organizations——From Perspective of Theory of Deviation Sociology

The business bribe by social organizations is the most typical deviated business behavior in modern society. Compared with the business bribery committed by individuals, the business bribe by social organizations has the following characteristics: a, organization is the subject; b, coordination of the intentions to act; c, the double effects of the behaviors; d, the organization is the sole beneficiary; and d, the scope of the behavior is limited. Being deeply affected by the market rules, the business bribe by social organizations is the result of careful business consideration which manifests the result of social exchange. We hold that by establishing appropriate social control systems in terms of the subject, the law and the relative means, the business bribe of social organizations can be put back to the normal track as lawful business transaction, then comes to be the result of rational selections.
