| 摘 要： | 我国的法律没有对商业秘密的权属性质进行界定 ,使得对商业秘密的保护缺乏法律依据。在学界 ,对商业秘密的定义没有一致认识 ,但都强调其所具备的三个特征 :秘密性、价值性、保密性 ,我国法律还强调其具有实用性的特征。我国目前法律对商业秘密保护不足 ,应从完善相关法律、明确范围、评估鉴定等方面完善我国对商业秘密的法律保护

| Abstract: | There is no definition on the nature of authority governing commercial secret in Chinese law, which makes it lack legal basis to protect commercial secret. In academic circle, although there is not a unanimous agreement on the definition of commercial secret, scholars all stress three characteristics: privacy, value, and confidentiality. Apart from this, Chinas law also stresses its practical features. At present, China lacks legal protection for commercial secret. As is proposed that China should perfect its legal protection for commercial secret in completion of relevant laws, in definition of scopes, and in evaluation and appraisal. |
